Terms of Service

Last updated: 1 January 2025This page outlines the terms of service that all parties must voluntarily agree to in relation to the design services provided by the artists 'ochibrochi'.The artist 'ochibrochi' will be referred to as the artist. Yourself, as an individual employing the services of the artist will be referred to as the client. The commission at any point of its progress may also be referred to as assets or the commission.

  1. The artist reserves the rights to alter the Terms of Service at any time, at their own discretion. The Client will only be affected by the version of Terms of Service at the time of agreement.

  2. The artist reserves all rights to all commissioned assets, including promotional usage (unless the commission is marked as private).

  3. The artist must be credited for when the asset is in use.

  4. Non-compliance with this term may result in an additional fee at the discretion of the artist.

  5. The client does not have the right to edit, manipulate, repurpose, redistribute, or resell the asset without prior consultation with the artist.

  6. The artist does not reserve the right to use/replicated any commissioned assets for commercial or financial gain without prior approval from the client.

  7. The artist reserves the right to deny service to a client, or to cancel a project at any time at their own discretion.

  8. Assets which call for detail and complexity beyond the initial scope may incur an additional fee per the discretion of the commission.

  9. All designs and concepts are to be derived from references provided from the client. Wherein references are lacking, non-specifiied aspects are to be decided at the discretion of the artist.

  10. The Client is obligated to give notice on any sensitive project deadlines. The artist takes no responsibility for missed deadlines if the former is failed to be mentioned.

  11. An additional fee may incur for rushed projects (under 2 weeks) at the discretion of the artist.

  12. Primary contact will be through Twitter, Bluesky, or Vgen, at the preference of the artist.

  13. Upon completion, assets will be delivered via email or WeTransfer, up to the preference of the client.

  14. No revisions are to be made after the delivery of the asset.

Delivery

  1. Upon completion, assets will be delivered via email or WeTransfer, up to the preference of the client.

  2. Delivery will be in the form of a PNG file to respective sizes (unless requested otherwise).

  3. Bust: 1748x2480

  4. Waist: 1748x2480

  5. Full body: 2480x 3508

  6. Chibi: 600x600

  7. Chibi Poster: 1080x1080

Commercial rights

  1. Assets do not include commercial rights by default.

  2. Commercial rights incur an additional fee of double the base price.

  3. Commercial rights include the use of assets for business and advertising purposes.

Payment

  1. All prices listed, and currency dealt with, is in USD (United States dollar). Clients based in Australia may be eligible for localised pricing.

  2. Payment will be made through PayPal invoice.

  3. Local payment (within Australia) can be processed via bank transfer.

  4. All invoices under $501 USD must be paid in full for the designer to begin creating the asset.

  5. Any invoice over $500 USD may be eligible for a payment plan upon request.

  6. No refund will be granted if the project is cancelled by the client at any time in the process, or after 30 days of non-communication from the client.

  7. After 30 days of non-communication from the client, the project will be cancelled and all files for the current version of the asset/s (at that point) will be sent.

  8. The client reserves the right to a full refund if the commission is cancelled by the artist at any time in the process.

Process

Once payment has been made, the process of commission will begin. There are multiple non-linear checkpoints, but updates will be provided along the following roadmap.

  1. Initial concept sketches and composition.

  2. Clean sketch/lineart.

  3. Colour.

  4. Rendering.

  5. Presentation of final commission, subject to 2 free revisions.

  6. File delivery.
